By accessing or using HEROIC.ai's employee productivity monitoring platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

HEROIC.ai provides an AI-powered employee productivity monitoring platform that includes desktop monitoring agents, time tracking, activity analytics, screenshot capture, and reporting dashboards. The Service is designed to help organizations understand and improve team productivity.

3. Account Registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to employee monitoring laws in your jurisdiction. You are responsible for obtaining any required consent from monitored employees.

5. Subscription and Billing

The Service is offered on a subscription basis. You agree to pay all fees associated with your selected plan. We reserve the right to modify pricing with 30 days' notice. Free trial periods may be offered at our discretion.

6. Data Ownership

You retain ownership of all data collected through the Service. We do not claim ownership of your monitoring data, employee information, or organizational data. We process this data solely to provide the Service to you.

7. Intellectual Property

The Service, including its software, design, and documentation, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEROIC.ai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless HEROIC.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will be disabled and your data will be retained for 30 days before permanent deletion, unless you request earlier deletion or export.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
